Kotwi Terms and Conditions

Welcome to Kotwi. Kotwi is a production cost and inventory tool for small businesses that make and sell physical products. It helps you track your ingredients and products, calculate your real production cost using weighted average costing, and record your sales to see your actual margins.
By creating an account or using Kotwi, you agree to these Terms and Conditions. If you do not agree with them, please do not use the service.
1. Accounts and Teams
1.1. To use Kotwi you need an account. You agree to provide accurate and complete information and to keep it up to date.
1.2. You must be at least 18 years old to use Kotwi.
1.3. You are responsible for keeping your credentials confidential and for all activity that happens under your account.
1.4. Kotwi organizes data in teams. If you own a team, you are responsible for the people you invite to it and for the data they enter. Team members can see and manage the business data of the teams they belong to.
2. Plans, Payments and Refunds
2.1. Kotwi offers a free plan and paid subscription plans. Paid plans unlock higher usage limits and additional features. Core cost calculation is available on every plan.
2.2. Payments are processed by Lemon Squeezy, which acts as the merchant of record for your purchase. Your payment is subject to Lemon Squeezy's own terms and privacy policy. Kotwi does not store your card details.
2.3. Subscriptions renew automatically at the end of each billing period until you cancel. You can cancel at any time; you keep access to paid features until the end of the period you already paid for.
2.4. If you are not satisfied, you can request a full refund within 14 days of your first subscription payment by writing to [email protected]. After that period, payments are not refundable, but you can cancel at any time as described above. Nothing in this section limits any statutory rights you may have as a consumer.
2.5. We may change our prices. If we do, we will notify you at least 30 days in advance, and the new price will apply from your next billing period. If we committed to a specific price for your subscription when you purchased it (for example, a founding member price), we will honor that commitment for as long as your subscription remains active.
3. Your Content and Your Data
3.1. You retain ownership of everything you enter into Kotwi: your products, recipes, ingredients, purchases, sales, images, and any other business data.
3.2. You grant Kotwi permission to host, store, and process that content solely to provide and improve the service.
3.3. You are responsible for the content you upload and guarantee that you have the rights to use it and that it does not infringe third-party rights.
3.4. Kotwi lets you record information about your own customers, such as names, email addresses, and phone numbers. You are responsible for having the right to store and use that information. Kotwi processes it on your behalf, only to provide the service, and never uses it for its own purposes.
4. Acceptable Use
You agree not to:
- Use Kotwi for unlawful purposes.
- Attempt to access other users' data or interfere with the operation of the service.
- Resell, sublicense, or provide the service to third parties as your own.
- Use automated means to extract data from the service beyond normal use of your own account.
5. Privacy
The collection and use of personal data are governed by our Privacy Policy, which is part of these terms.
6. Not Professional Advice
Kotwi calculates costs and margins from the data you enter. These calculations are informational tools for running your business; they are not accounting, tax, or financial advice. You are responsible for verifying any figures you use for legal, tax, or accounting purposes.
7. Cancellation and Termination
7.1. You can cancel your account at any time from the application or by writing to [email protected].
7.2. When your account is deleted, your data is removed from our active systems as described in our Privacy Policy. You may request a copy of your data before deleting your account.
7.3. Kotwi may suspend or terminate your account if you breach these terms. For any other reason, we will give you reasonable prior notice so you can export your data.
8. Changes to the Service and These Terms
8.1. Kotwi is an evolving product; features may change over time. If we discontinue the service or a material part of it, we will give you reasonable prior notice.
8.2. We may update these Terms and Conditions from time to time. If a change is significant, we will notify you before it takes effect. Continuing to use the service after a change takes effect means you accept the updated terms.
9. Disclaimer and Limitation of Liability
9.1. Kotwi is provided "as is" and "as available", without warranties of any kind, express or implied. We work to keep the service available and your data safe, but we cannot guarantee uninterrupted or error-free operation.
9.2. To the maximum extent permitted by law, Kotwi will not be liable for indirect, incidental, special, consequential, or punitive damages, nor for loss of profits or business.
9.3. To the maximum extent permitted by law, Kotwi's total liability for any claim related to the service is limited to the amount you paid us in the 12 months before the event giving rise to the claim.
10. Governing Law and Disputes
10.1. These Terms and Conditions are governed by the laws of Peru.
10.2. Any dispute related to these terms will be resolved before the competent courts of Peru. If you are a consumer, this does not deprive you of the protection of mandatory consumer laws of your country of residence.
